KWIKPOP, Inc. (“KWIKPOP,” “we,” “us,” or “our”) provides trading software, services, websites, and related communications (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and protect information in connection with the Services, including any SMS/MMS messaging programs we operate.
By using the Services, you agree to the practices described here. If you do not agree, please do not use the Services.
1) Information We Collect
a) Information You Provide
- Account & Contact Data: name, email address, phone number, company, job title, password.
- Billing & Transactions: billing address and limited payment information (we use third-party processors and generally do not store full payment card numbers).
- Customer Support & Communications: messages, call notes, emails, in-app chats.
- Marketing Preferences: opt-in/opt-out status, topics of interest.
- Trading-Related Inputs (If Provided): indicator settings, symbol lists, log files or optional telemetry reports you submit.
- We do not require your brokerage credentials to use our software; if you choose to provide any third-party credentials for integrations, we will process them only to enable that integration.
b) Information Collected Automatically
- Device & Usage Data: IP address, device identifiers, OS/browser type, pages viewed, timestamps, crash logs, software version, and feature interaction.
- Cookies & Similar Tech: session cookies, analytics cookies, and pixels to provide, secure, and improve the Services and measure marketing performance. You can control cookies via your browser settings (functionality may be affected).
c) Information from Third Parties
- Service Providers & Partners: limited data (e.g., support context, fraud indicators, or aggregated analytics).
- Referrals & Affiliates: if you arrive via a referral/affiliate, we may receive attribution information.
2) How We Use Information
We use information to:
- Provide, operate, maintain, secure, and improve the Services and our software.
- Process transactions and send related notices (confirmations, invoices, updates).
- Provide customer support and respond to requests.
- Configure indicators, license access, and optional telemetry or diagnostics you enable.

We may de-identify or aggregate information and use it for analytics, product development, and benchmarking. De-identified/aggregated data is not used to identify you.
3) SMS/MMS (A2P 10DLC) Messaging Disclosure
KWIKPOP may operate one or more SMS/MMS programs (e.g., “KWIKPOP Alerts”) for account notifications, security verifications, service updates, or limited marketing messages where permitted.
- Opt-In Consent: You will not receive SMS/MMS from us unless you (a) provide your mobile number and (b) consent (e.g., checking a box on a form or texting a keyword to opt-in).
- Message Frequency: Message frequency varies.
- Opt-Out: You can opt out at any time by replying STOP to any message. You may receive a one-time confirmation text.
- Help: For help, reply HELP or contact us at [support@kwikpop.com] or [XXX-XXX-XXXX].
- Carrier Disclosure: Carriers are not liable for delayed or undelivered messages.
- Costs: Message and data rates may apply.
- Data Use: We use your mobile number and messaging metadata to deliver messages, maintain logs for compliance, and prevent abuse. We do not sell your mobile number. We may share it with messaging vendors solely to send and deliver messages.
- Your consent to receive SMS/MMS is not a condition of any purchase. You can continue to use the Services even if you opt out of SMS/MMS.
4) Legal Bases for Processing (EEA/UK/Similar Jurisdictions)
Where applicable, we process personal data under one or more of the following legal bases: (i) to perform a contract (provide the Services), (ii) with your consent (e.g., marketing SMS/email), (iii) our legitimate interests (e.g., securing and improving the Services), and (iv) compliance with legal obligations.
5) How We Share Information
We share information as follows:
- Service Providers/Processors: with vetted vendors who help us deliver the Services (hosting, analytics, message delivery, customer support, payment processing, fraud prevention). They may access personal data only to perform services for us and must handle it in accordance with this Policy and applicable law.
- Business Transfers: in connection with a merger, financing, acquisition, or dissolution, your information may be transferred as part of that transaction, subject to appropriate protections.
- Legal/Compliance: to comply with laws, lawful requests, or to protect rights, safety, and property (ours, yours, or others).
- With Your Direction or Consent: if you request an integration or share content, we disclose as needed to fulfill your request.
- We do not sell personal information. We may share limited data for “targeted advertising” or “cross-context behavioral advertising” only with your consent where required, and you can opt out as described below.
6) Data Retention
We retain information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, protect our rights, and enforce agreements. Retention periods vary by data type and context. We may retain de-identified or aggregated data indefinitely.
7) Your Choices & Rights
- Email/SMS Opt-Out: Unsubscribe links (email) and STOP (SMS/MMS).
- Cookie Controls: Manage via browser settings or cookie banners where provided.
- Access, Correction, Deletion: You may request access to, correction of, or deletion of your personal information by contacting us (see Section 13). We will respond as required by applicable laws.
- Do Not Track / Global Privacy Control: We honor applicable legal requirements regarding browser or platform privacy signals where mandated.
- State Privacy Rights (U.S.): If you reside in a state with privacy rights (e.g., CA, CO, CT, UT, VA), you may have rights to know, access, correct, delete, and/or opt out of certain data uses. Submit requests using the contact details below. If we deny a request, you may have the right to appeal—instructions will be provided in our response.
- EEA/UK/Switzerland: You may have rights to access, rectify, delete, restrict, port, or object to processing. You may also lodge a complaint with your local supervisory authority.
- We may take steps to verify your identity before fulfilling requests.
8) Data Security
We employ administrative, technical, and physical safeguards designed to protect personal information (e.g., encryption in transit, access controls, logging). No method of transmission or storage is 100% secure; we cannot guarantee absolute security.
9) International Transfers
We may process and store information in the United States and other countries. Where required, we use appropriate safeguards (such as Standard Contractual Clauses) for cross-border data transfers.
10) Children’s Privacy
Our Services are not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.
11) Third-Party Services and Links
The Services may link to third-party sites, tools, brokers, or platforms. Their privacy practices are governed by their own policies. We are not responsible for third-party privacy practices.

We may update this Privacy Policy from time to time. The “Last Updated” date indicates the latest revision. Material changes will be posted on our website and, where required, we will obtain your consent.

14) U.S. State-Specific Notices (California & Others)
California (CPRA): We do not “sell” personal information as defined by CPRA. We may “share” personal information for cross-context behavioral advertising only with consent where required; you can opt out by contacting us or adjusting your cookie settings. We collect the categories of personal information described in Section 1 for the purposes described in Section 2 and share with service providers as described in Section 5. We retain personal information consistent with Section 6. California residents may exercise rights described in Section 7.
Nevada: We do not sell “covered information” as defined under Nevada law. You may submit opt-out requests using the contact details above.
15) Program-Specific Disclosures (If Applicable)
From time to time, we may offer program-specific terms that supplement this Policy (e.g., beta telemetry, affiliate programs, contests). If a supplemental notice conflicts with this Policy, the supplemental notice governs for that program.
